1. Acceptance of Terms

By accessing or using CryptoBattle (the "Platform"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you may not access or use the Platform. These Terms constitute a legally binding agreement between you and CryptoBattle.

Your continued use of the Platform following any modifications to these Terms constitutes acceptance of those modifications. We reserve the right to modify these Terms at any time without prior notice.

2. User Eligibility

To use CryptoBattle, you must:

  • Be at least 18 years of age or the age of majority in your jurisdiction
  • Have the legal capacity to enter into binding agreements
  • Not be located in, or a citizen or resident of, any jurisdiction where use of the Platform is prohibited
  • Not be subject to economic sanctions or designated on any list of prohibited or restricted parties

Restricted Jurisdictions: The Platform is not available to users in jurisdictions where cryptocurrency activities are prohibited by law or where the Platform has determined access should be restricted.

3. Platform Description

CryptoBattle is a decentralized voting platform that implements a commit-reveal mechanism for fair and transparent voting on meme battles. Users can:

  • Create voting rounds with customizable parameters
  • Commit cryptographic votes during the commit phase
  • Reveal votes during the reveal phase
  • Claim rewards after round finalization

The Platform operates on blockchain technology with smart contracts that execute autonomously. CryptoBattle does not custody user funds; all assets remain in users' self-custodied wallets at all times.

4. No Financial Advice

IMPORTANT: Nothing on CryptoBattle constitutes financial, investment, legal, or tax advice. The Platform is provided for entertainment and informational purposes only. You should:

  • Conduct your own research before participating in any rounds
  • Consult qualified professionals for financial, legal, or tax advice
  • Never stake more than you can afford to lose
  • Understand that all participation is at your own risk

CryptoBattle is not a financial advisor, broker, or investment manager. We do not recommend any particular voting strategy or outcome.

5. Risk Acknowledgments

By using the Platform, you acknowledge and accept the following risks:

Blockchain Risks

  • All blockchain transactions are irreversible and permanent
  • Network congestion may cause delays or failed transactions
  • Loss of private keys results in permanent loss of funds with no recovery mechanism
  • Blockchain networks may experience forks, attacks, or temporary unavailability

Cryptocurrency Risks

  • Digital assets experience extreme price volatility
  • Regulatory changes could affect the legality or value of digital assets
  • Liquidity may not always be available at expected prices

Platform-Specific Risks

  • Voting outcomes depend on other participants' actions
  • Minority voting is inherently riskier and may result in total loss of stake
  • Platform fees and parameters may change at any time
  • Service may be suspended or unavailable without notice

6. Commitment-Reveal Mechanism

CryptoBattle uses a cryptographic commit-reveal scheme to ensure fair voting. You must understand:

CRITICAL WARNING:

  • Salt Management: You are solely responsible for generating and securely storing your cryptographic salt
  • No Recovery: CryptoBattle does NOT store salts and CANNOT recover lost salts under any circumstances
  • Lost Salt = Lost Stake: If you lose your salt, you cannot reveal your vote, and your stake is permanently lost
  • Time Limits: Reveals must occur within the reveal phase; late reveals are rejected

Your commitment is calculated as: keccak256(contractAddress, roundId, voterAddress, side, salt)

Unrevealed Stakes: Stakes from commitments that are not revealed during the reveal phase are forfeited and transferred to the platform treasury. This is permanent and non-reversible.

7. Smart Contract Risks

CryptoBattle operates through immutable smart contracts deployed on the blockchain. You acknowledge that:

  • Smart contract code is deterministic and controls all funds according to its programmed logic
  • The CryptoBattle team cannot reverse, modify, or halt transactions once submitted to the blockchain
  • Smart contracts may contain bugs or vulnerabilities that could result in loss of funds
  • No guarantee is made that the smart contracts are free from defects or exploits
  • Users can independently verify contract code on the blockchain

By interacting with our smart contracts, you accept all risks associated with blockchain technology and decentralized applications.

8. No Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, CRYPTOBATTLE DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties that the Platform will be uninterrupted, error-free, or secure
  • Warranties that the Platform will meet your expectations or requirements
  • Warranties regarding the accuracy or completeness of any information provided

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CRYPTOBATTLE AND ITS FOUNDERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, or goodwill
  • Loss or theft of digital assets or cryptocurrency
  • Unauthorized access to your wallet or account
  • Third-party actions, including smart contract exploits
  • Any damages arising from your use or inability to use the Platform

IN NO EVENT SHALL CRYPTOBATTLE'S TOTAL LIABILITY EXCEED THE LESSER OF: (A) ONE HUNDRED US DOLLARS ($100); OR (B) THE TOTAL FEES PAID BY YOU TO THE PLATFORM IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless CryptoBattle and its founders, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any applicable laws or regulations
  • Your infringement of any third-party rights
  • Any claims by third parties relating to your conduct on the Platform

11. Prohibited Conduct

You agree NOT to:

  • Violate any applicable laws, regulations, or third-party rights
  • Engage in money laundering, terrorist financing, or sanctions evasion
  • Use the Platform for fraud, scams, or deceptive practices
  • Manipulate voting outcomes through wash trading or collusion
  • Attack, hack, or exploit the Platform or smart contracts
  • Access the Platform from restricted jurisdictions (including via VPN)
  • Use automated tools, bots, or scrapers without authorization
  • Engage in front-running or other market manipulation
  • Spam, harass, or threaten other users
  • Submit malware, viruses, or malicious code

12. Intellectual Property

All content on the Platform, including but not limited to code, graphics, text, logos, and trademarks, is the property of CryptoBattle or its licensors. You may not:

  • Copy, reproduce, or modify Platform content without permission
  • Create derivative works based on Platform content
  • Use Platform content for commercial purposes without authorization
  • Remove any copyright or proprietary notices

"CRYPTOBATTLE" and related trademarks are protected. You may use the Platform for personal, non-commercial purposes only.

13. Dispute Resolution

Binding Arbitration: Any dispute arising from or relating to these Terms or the Platform shall be resolved through binding arbitration, rather than in court. The arbitration shall be conducted in accordance with applicable arbitration rules.

Class Action Waiver: YOU AGREE TO WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. All claims must be brought in your individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.

Round Resolution: CryptoBattle determines all voting round outcomes at its sole discretion. Round resolutions are final and binding with no appeals process. Disputes regarding round outcomes must be submitted within 7 days of finalization.

14. Fee Structure

The Platform charges fees that are deducted from the loser pool before winner distribution:

  • Platform Fee: A percentage of the loser pool, as displayed on the Platform at the time of round creation
  • Creator Reward: A percentage of the loser pool, paid to the round creator as displayed at the time of round creation
  • Gas Fees: Users are responsible for all blockchain transaction fees

Fee structure may change at any time without notice. Updated fees apply to new rounds only. The specific fee percentages are displayed in the Platform interface and smart contract parameters. No refunds or fee reductions will be provided.

15. Modifications

CryptoBattle reserves the right to modify these Terms at any time. Material changes will be announced through the Platform. Your continued use of the Platform after any modifications constitutes acceptance of the updated Terms.

If you disagree with any modifications, you must cease using the Platform immediately. CryptoBattle is not liable for any damages arising from modifications to these Terms.

16. Termination

CryptoBattle may terminate or suspend your access to the Platform at any time, with or without cause, and with or without notice. Grounds for termination include but are not limited to:

  • Violation of these Terms
  • Suspected fraudulent or illegal activity
  • Use from restricted jurisdictions
  • Any reason at our sole discretion

Upon termination, you remain liable for all activity on your account prior to termination. The following sections survive termination: Risk Acknowledgments, No Warranties, Limitation of Liability, Indemnification, Dispute Resolution, and Intellectual Property.

17. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any legal proceedings arising from these Terms shall be conducted in the jurisdiction specified in the arbitration clause.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.
